This Acceptable Use Policy ("AUP") is constructed by OdysseyHost Limited to supplement and explain certain terms of the Terms of Use and is intended as a guide to the customer's rights and obligations when utilizing OdysseyHost's services. Every customer of OdysseyHost is responsible for obtaining and conforming to the Terms of Use and the AUP. The validity, construction and performance of this AUP shall be governed by the law of Hong Kong Special Administrative Region.

As a provider of web site hosting and other Internet-related services, OdysseyHost only offers its customers the means to disseminate information through the Internet, it does not review, edit, censor, or take responsibility for any information its customers may create and disseminate, however, OdysseyHost reserves the right to take certain preventative or corrective actions, including but not limited to, immediate account termination without warning and refund when customers engage in the following prohibited activities:

Spamming
Spamming is the act of sending unsolicited bulk and/or commercial messages over the Internet. Spamming is not only harmful because of its negative impact on the reputation and goodwill of OdysseyHost, but also because it may overload OdysseyHost's servers and network and disrupt services to its customer. If the messages sent by the customer is determined by OdysseyHost from all of the evidence that it is a spam, the related hosting account may be suspended without prior notice.

Unlawful Content
OdysseyHost does not permit its services to be used for web sites or activities which:
(a) infringe the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities;
(b) include adult, pornographic or any sexual contents, hyperlinks or banner exchanges;
(c) include pirated softwares, DVD, MP3 downloads, hyperlinks or banner exchanges;
(d) include defamatory, harassing, abusive or threatening language.

Background Running Programs
Background running programs in general are prohibited on OdysseyHost's servers, including but not limited to, IRC, IRC-Bots, BNC's, eggdrops, BitchX, XiRCON and any other daemons that utilize excessive system resources and interfere with normal server operation. OdysseyHost will be the sole arbitrator of what constitutes a violation of the above policy.

Excessive Resource Consumption
Any customer who is using very CPU intensive programs and/or scripts that utilize excessive CPU cycles or any system resources will be warned, and if not removed, the relevant program/script will be terminated.

Illgeal Access to Other Computer Networks
Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's or corporation's system is strictly prohibited.

Other Activities
Activities, whether lawful or unlawful, that OdysseyHost determines to be harmful to its customers, operations, reputation, goodwill or customer relationship.
