The objective of this Acceptable Use Policy (“AUP”) is to supplement and elaborate certain terms of the Terms of Service, further describes user's obligations when using OdysseyHost's services. You agree to maintain on your service account in full compliance to OdysseyHost’s TOS and this AUP. If your account provisioned is found to violate or abuse any terms of the AUP at any time, OdysseyHost reserve the right to take preventive or corrective actions to immediately suspend your account without prior notice. Re-activation of your account suspended for violation of our AUP will subject to a re-activation fee of HKD300. OdysseyHost has the sole right to decide whether you have taken appropriate corrective measures to remove the violation, and whether your account is qualified for re-activation.

OdysseyHost reserves the right to cancel and terminate any account that has been suspended for 7 days. Any backup copies of your account will be deleted upon account termination and previous service prepayments will not be refunded.

Bulk Email or Spamming

Spamming is the act of sending unsolicited, bulk and/or commercial messages. Spamming is not only harmful because of its negative impact on the reputation and goodwill of OdysseyHost, but also because it can overload our server system and network and disrupt service to our users. You agree not to transmit any unsolicited, commercial and/or bulk email through our mail server, or engage in any activity known or considered to be spamming, bulk mailing or mail bombing. Such activities include but not limited to activities resulting in blacklisting of OdysseyHost’s IP by any of the online spam databases.

Unlawful Content

You agree not to use OdysseyHost account to host any websites, links or advertisements, or store any data that:

1. infringe the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities;
2. contain adult, pornographic, obscene or any sexual contents, hyperlinks or banner exchanges;
3. contain copyrighted softwares, music files, video files, DVD, MP3 downloads, hyperlinks or banner exchanges; contain defamatory, harassing, abusive or threatening language;
4. contain viruses, Trojan horses, worms, time bombs, Phishing codes or any other similar malicious software or codes with a destructive nature;
5. contain Torrent trackers, Torrent Portals or similar software;
6. promote multi-level marketing or similar unlawful activities.

The above prohibited contents will be removed from the server immediately without prior notice and may lead to possible account suspension or termination with no refund.

Programs and Scripts

You are responsible for ensuring that all programs and scripts installed under your account are secure. You agree not to install or execute programs and/or scripts that utilize excessive CPU cycles or any resources, OdysseyHost reserves the right to remove those scripts or programs immediately once discovered and may lead to account suspension or termination if our warning is neglected.

You agree not to install and/or run those unaccepted programs or scripts under your account, including but not limited to IRC, IRC-Bots, Proxy Scripts, Warez, mirror, BNC's, eggdrops, BitchX, XiRCON, rapidshare, photobucket, IP scanners, Brute Force Programs, mail bombers and any other related programs. OdysseyHost will be the sole arbitrator of what constitutes a violation of this policy.

Password Security

Upon new account activation, OdysseyHost will send you the username and password to access to your account and the control panel. You are responsible to maintain the security and confidentiality of your username and password. OdysseyHost reserves the right to carry out regular audits of your login credentials in respect of security level. In case your credentials are found not to be secure enough, we will notify and advise you to change to a more secure one. If security condition is not improved within a certain time frame, we will change your login credentials and provide them to you.

You can request a password retrieval at any time from our control panel, your control panel password will be automatically sent to you by system through email in plain text. You are solely responsible for changing the received password to a new one immediately, where OdysseyHost is not responsible for any damage or loss to your account if your control panel password was intercepted or stolen during email transmission.

Network Activity

You agree that you are solely responsible for all actions and activity taken under your account.

You agree not to allow any remote code execution of malicious software through the hosting account provided by OdysseyHost.

You agree not to cause denial of service attacks, port scans or other invasive activities against OdysseyHost servers and network facilities.

You agree not to access illegally or without authorization computers, servers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's or corporation's system.

Miscellaneous

You agree that you will not violate any laws, regulations, ordinances of the local government. You agree not to engage in any activity, whether lawful or unlawful while you are using our Service, that OdysseyHost determines to be harmful to its customers, operations, reputation, goodwill or customer relations.
